THE QUEENS DWI STOP

The most common way people are arrested for a DWI in Queens, is by being stopped by the NYPD for some alleged traffic infraction. Often, the police have no legal reason to pull a motorist over and will do so simply based on the time of day or the fact that they are in an area with a large number of bars.

After the initial stop, the police will ask you if you have been drinking. It is at this point that if you admit to drinking any amount of alcohol, you will be taken to jail. It is very rare for people to admit to drinking and not be arrested. If the facts are not in their favor, the police will simply manfacture them.

After you are placed in handcuffs, you will be brought back to a precinct that has a breathalyzer machine and asked to take a breathalyzer. If you refuse, the DMV will attempt to take your license for one year. Because the breathalyzer machines do not work properly, most Queens DWI lawyers would advise their clients not to blow into the machine.
